1. Application

These terms govern the sale by MEKUTI (the seller) to YOU (the buyer) of Products ordered by you and accepted by MEKUTI.
The buyers acceptance of the Products shall be deemed to constitute acceptance of these terms.

2. Orders

All orders placed by YOU are subject to acceptance by MEKUTI.
MEKUTI reserves the right to revise prices, limit quantities, correct errors on the website and refuse orders at their discretion, without limitation. Except as may otherwise be permitted by applicable law, YOU may not cancel an order which MEKUTI has accepted without the agreement in writing of MEKUTI, which requirement may be waived by MEKUTI from time to time at their sole discretion.
Acceptance of your order is no guarantee that the size and colour of your choice is in stock. You will be offered an alternative or a refund in this instance.
Trade Order Promotional Codes are strictly only available for use by Trade Customers authorised by MEKUTI in advance.
Trade Order Promotional Codes are valid only for orders with a net value of over £40, before discount. Trade Orders will be validated before processing and may be cancelled if they don't comply with this condition, in such a case, YOU will be notified and payment will be refunded in full.
MEKUTI reserves the right to de-authorise or vary the terms of use of the Trade Order Promotional Codes at their dicretion.

3. Delivery

MEKUTI will endeavour to deliver your order within 2 working days via Royal Mail (UK only) when the items are in stock but may take up to 30 days following your order. This may be subject to seasonal variations. MEKUTI shall not be liable for any cost or damage caused by late or non-delivery of your order. MEKUTI reserves the right to deliver the Products in instalments.

4. Payment

All payments for Products are to be made in UK Pounds sterling. YOU must pay for the Products at the time of ordering. MEKUTI reserves the right, by giving notice at the time the order is placed, to increase the price of the Products to reflect any increase in the cost to themselves which is due to any factor beyond their control.

5. 30 Day Guarantee

This guarantee covers all the items sold by MEKUTI on this website for a period of 30 days within receipt of the items. Any item returned under this guarantee (and within the 30 day period) is eligible for a full refund (including original post and packing). All returns must be clean and un-damaged and if possible in their original packaging. We recommend that you obtain proof of posting for returned items.Your statutory rights under the Distance Selling Regulations are unaffected.

5a. Returns for Exchange.

Any item returned under the guarantee (as above) which is only for exchange of size or colour must be accompanied by the appropriate return post and packing rate. Please telephone on 01132 590 589 or email first to obtain a returns number. We recommend you to obtain proof of posting.

6. Cancellations and Refunds

If you wish to cancel your order before the goods have arrived, you must notify us by email or letter stating your name, address and order number and that you wish to cancel the goods. If you wish to cancel the order after you have received the goods this is covered under the thirty day guarantee as stated at 5 (above). You must inform us before the thirty days (after the goods have been delivered) have expired and contacted us to receive a RETURNS NUMBER.

Under the Distance Selling Regulations (2000) you have a duty to take reasonable care of the goods whilst in your possession. You are entitled to a full refund (including post and packing) for any of the goods you have ordered. However, if any goods are returned damaged then Mekuti withold the right to offer a lower level of refund to reflect any such damage. (In exceptional cases this could mean that you receive no money for damaged goods).

7. Warranty

Subject to the limitations on its liability set out in these terms, MEKUTI warrants that the Products will be free from defects in material and workmanship for a period of one year from the date of delivery. MEKUTI shall be under no liability in respect of any defect arising from fair wear and tear, willful damage, negligence, abnormal working conditions or misuse. If YOU notify MEKUTI of a valid claim under this warranty within the one year period MEKUTI will replace or repair the Product or refund the cost of the Product (not including post and packing), at MEKUTI's discretion, but MEKUTI shall have no other liability to YOU. Please note that if YOU return equipment under this warranty the goods should be in a clean and dry condition.

8. Liability

Nothing in these Terms shall exclude or limit MEKUTI's liability for fraud or for death or personal injury caused by its negligence or any other liability to the extent that the same may be excluded or limited as a matter of law. Without prejudice to the previous sentence, MEKUTI shall not be liable for any loss of income or profits or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by the negligence of MEKUTI, breach or non-performance or any of the obligations under these Terms or otherwise. These Terms set out the full extent of MEKUTI's obligations and liabilities in respect of the sale of the Products. In particular there are no conditions, warranties or other terms, expressed or implied, as to satisfactory quality, fitness for a particular purpose, or any other kind whatsoever, that are binding on MEKUTI except as specifically stated in these Terms. Any condition, warranty or other term concerning the sale of these Products, which might otherwise be implied into or incorporated within these Terms by statute, common law or otherwise, is excluded to the fullest extent permitted by law. If YOU are a consumer the exclusion of terms implied by law will not apply to you.

9. General Conditions

MEKUTI shall not be liable to YOU for any loss or damage which YOU might suffer arising from MEKUTI's delay in fulfilling or failure to fulfill any obligations under these terms to the extent that such delay or failure is caused by circumstances beyond MEKUTI's reasonable control. These Terms and any terms appearing on any other form to which these terms apply constitute the entire agreement between YOU and MEKUTI relating to the Products. The failure of MEKUTI or YOU to enforce any of these Terms does not constitute a waiver of that term and shall in no way affect the right later to enforce the term. The invalidity or enforceability of any clause of these Terms shall not adversely affect the validity or enforceability of the remaining provisions. No amendment, variation or addition to these Terms shall be binding unless agreed to in writing by MEKUTI. These Terms will be construed in accordance with the laws of England and any disputes shall be settled by the English courts.

10. Security and Privacy Policy

MEKUTI will retain your name, address, telephone number, email address and order history both on computer and on paper solely for the purpose of supplying your order. The only people with access to your data are the sole employees or partners of Mekuti. We do not supply or sell these details to any third parties, except where noted below necessary for carrying out the supply of your order. Such details are governed by the rules of the Data Protection Act 1998. Under this act, with notification in writing, you are entitled to have a copy of the details that Mekuti hold and if any such details are incorrect Mekuti will amend these details. It is your legal right to request removal of your personal details at any time.

Cookies are not used on our website but once an item is placed in the shopping cart, data is transferred to a third-party (Romancart.com) who then uses cookies to keep track of the items in your cart. Proceeding to the checkout will take you to a secure (128-bit encryption SSL) part of Romancart where your personal details are entered (these can get stored for your next purchase if you request it). Please check for the golden padlock at the bottom of your browser. Credit or debit card handling and authorisation is carried out through a secure SSL gateway (Protx). You will receive an email from Romancart notifying you of your purchase. If for any reason there will be an unreasonable delay in supplying any of your items then we will endeavour to inform you and you may decide to cancel the order.

We do not send random marketing emails to personal email addresses (spam) except as noted below. We do not sell or pass email address lists to third parties.

Please note that if you have chosen to accept marketing emails from us then we may email you at various times throughout the year with special offers or new products. You can choose to remove yourself from the mailing list when you receive any of these emails.

Images and text contained throughout this website and in MEKUTI company literature in printed or digital format, including, but not limited to, the Mekuti Product Brochure, Mekuti Price List, Mekuti branded information leaflets, Mekuti branded advertising leaflets, Mekuti advertisements in print and Mekuti advertisements found online, can only be used to promote and demonstrate the Mekuti,Neem Genie and Neem 40 branded products shown on this website. Such usage must have in all instances have direct links to the Mekuti website and acknowledge copyright and reserved rights to Mekuti and Rachael Greenland.

Original photography is owned by MEKUTI, and in the case of supplied photography by product users, Mekuti have been given the sole right to use such imagary for promotional and educational use by Mekuti alone.

The 'Mekuti Balance Harness', 'Mekuti Leg Wrap', Mekuti TTouch Body Wrap', 'Mekuti Calming Band' are all trade mark products registered to Mekuti and Rachael Greenland ®2010.

12. Defined Terms

"MEKUTI" (the seller) means Mekuti, Glendale, Newlay Wood Avenue, Horsforth, West Yorkshire, LS18 4LN
"YOU" (the buyer) means the purchaser of any Product(s) from MEKUTI
"Terms" means these Terms and Conditions of sale
"Products" means any product listed on this website for sale for which YOU place an order which is accepted by MEKUTI
