MEKUTI Terms & Conditions

1. Application

These terms govern the sale by MEKUTI (the seller) to YOU (the buyer) of Products ordered by you and accepted by MEKUTI.
The buyers acceptance of the Products shall be deemed to constitute acceptance of these terms.

2. Orders

All orders placed by YOU are subject to acceptance by MEKUTI.
MEKUTI reserves the right to revise prices, limit quantities, correct errors on the website & refuse orders at their discretion, without limitation. Except as may otherwise be permitted by applicable law, YOU may not cancel an order which MEKUTI has accepted without the agreement in writing of MEKUTI, which requirement may be waived by MEKUTI from time to time at their sole discretion.

3. Delivery

MEKUTI will endeavour to deliver your order within 2 working days when the items are in stock but may take up to 28 days following your order. This may be subject to seasonal variations - an indication of approximate dispatch dates will be given upon receipt of your order. MEKUTI shall not be liable for any cost or damage caused by late or non-delivery of your order. Any delay in delivery shall not give YOU the right to reject the Products or cancel the order. MEKUTI reserves the right to deliver the Products in instalments.

4. Payment

All payments for Products are to be made in UK Pounds sterling. YOU must pay for the Products at the time of ordering. MEKUTI reserves the right, by giving notice at the time the order is placed, to increase the price of the Products to reflect any increase in the cost to themselves which is due to any factor beyond their control.

5. 30 Day Guarantee

This guarantee covers all the items sold by MEKUTI on this website (except clothing and books) for a period of 30 days within receipt of the items. Any item (except clothing and books) returned under this guarantee (and within the 30 day period) is eligible for a full refund (excluding post & packing). All returns must be clean and un-damaged. Your statutory rights are unaffected.

• 5a. Returns for exchange.

  Any item returned under the guarantee (as above) which is for only for exchange of size or colour must be accompanied by the appropriate return post and packing rate. (If you are in doubt as to the return postage costs, please telephone Rachael Manns on 01938 811777) .

 

6. Warranty

Subject to the limitations on its liability set out in these terms, MEKUTI warrants that the Products will be free from defects in material & workmanship for a period of one year from the date of delivery (or a period of two years in respect of the Balance Harness). MEKUTI shall be under no liability in respect of any defect arising from fair wear & tear, willful damage, negligence, abnormal working conditions or misuse. If YOU notify MEKUTI of a valid claim under this warranty within the one year period (or within the two year period in respect of the Balance Harness), MEKUTI will replace or repair the Product or refund the cost of the Product (not including post & packing), at MEKUTI's discretion, but MEKUTI shall have no other liability to YOU. Please note that if YOU return equipment under this warranty the goods should be in a clean, dry and un-damaged condition.

7. Liability

Nothing in these Terms shall exclude or limit MEKUTI's liability for fraud or for death or personal injury caused by its negligence or any other liability to the extent that the same may be excluded or limited as a matter of law. Without prejudice to the previous sentence, MEKUTI shall not be liable for any loss of income or profits or for any indirect or consequential loss or damage of any kind howsoever arising & whether caused by the negligence of MEKUTI, breach or non-performance or any of the obligations under these Terms or otherwise. These Terms set out the full extent of MEKUTI's obligations & liabilities in respect of the sale of the Products. In particular there are no conditions, warranties or other terms, expressed or implied, as to satisfactory quality, fitness for a particular purpose, or any other kind whatsoever, that are binding on MEKUTI except as specifically stated in these Terms. Any condition, warranty or other term concerning the sale of these Products, which might otherwise be implied into or incorporated within these Terms by statute, common law or otherwise, is excluded to the fullest extent permitted by law. If YOU are a consumer the exclusion of terms implied by law will not apply to you.

8. General

MEKUTI shall not be liable to YOU for any loss or damage which YOU might suffer arising from MEKUTI's delay in fulfilling or failure to fulfillany obligations under these terms to the extent that such delay or failure is caused by circumstances beyond MEKUTI's reasonable control. These Terms & any terms appearing on any other form to which these terms apply constitute the entire agreement between YOU & MEKUTI relating to the Products. The failure of MEKUTI or YOU to enforce any of these Terms does not constitute a waiver of that term and shall in no way affect the right later to enforce the term. The invalidity or enforceability of any clause of these Terms shall not adversely affect the validity or enforceability of the remaining provisions. No amendment, variation or addition to these Terms shall be binding unless agreed to in writing by MEKUTI. These Terms will be construed in accordance with the laws of England and any disputes shall be settled by the English courts.

9. Defined Terms

"MEKUTI" (the seller) means Mekuti, Rhiwhiriaeth Uchaf, Llanfair Caereinion, Welshpool, Powys, Wales
"YOU" (the buyer) means the purchaser of any Product(s) from MEKUTI
"Terms" means these Terms & Conditions of sale
"Products" means any product listed on this website for sale for which YOU place an order which is accepted by MEKUTI

Order value up to and including £10.00 - P&P £1.50.
Order value between £10.01 and £50.00 - P&P £2.50
Order value between £50.01 and £75.00 - P&P £3.50
Order value between £75.01 and £100.00 - P&P £4.50
Order value between £100.01 and £150.00 - P&P £5.50
Order value over £150.00 - P&P £6.50

European Rates (Airmail where possible)
